Booking Terms and Conditions

These Booking Terms and Conditions apply to photography and related creative services supplied by Capture the Story.
A project-specific quote, proposal or agreement may include additional terms. Where there is an inconsistency, the project-specific agreement will apply to the extent of that inconsistency.
1. Business details

In these terms, “Capture the Story”, “we”, “us” and “our” refer to the business identified above. “Client”, “you” and “your” refer to the person or organisation booking the services.
2. Quotes and scope
Quotes are prepared using the information available at the time they are issued.
Each quote or agreement will identify the agreed services, which may include:
Photography date and location
Coverage duration
Package or project scope
Number of delivered photographs
Editing and retouching
Video or additional creative services
Delivery method
Usage rights
Price and payment schedule
Travel or additional costs
Unless otherwise stated, a quote remains valid for 30 days.
A quote does not reserve a date until the booking requirements described below have been completed.
Any request outside the agreed scope may require a revised quote or additional fee.
3. Confirming a booking
A booking is confirmed when:
The client accepts the quote or agreement;
The client accepts these Booking Terms and Conditions; and
The required booking fee has been received.
Enquiries, discussions, provisional dates and unpaid invoices do not secure a booking.
Dates remain available to other clients until the booking is formally confirmed.
4. Booking fee
A booking fee of 50% is required to reserve the agreed date.
The booking fee compensates Capture the Story for reserving the date and beginning work that may include:
Client communication
Project planning
Questionnaires
Location research
Shot-list preparation
Scheduling
Administration
Declining other work for the reserved period
The treatment of the booking fee following cancellation or rescheduling is explained below.
Nothing in these terms limits any rights or remedies that cannot legally be excluded under the Australian Consumer Law.
5. Payment
Unless otherwise stated in the quote:
The booking fee is due when the booking is accepted.
The remaining balance is due before delivery of files.
Retainer or ongoing services are invoiced Monthly.
Additional services are invoiced separately.
Photographs may not be released until all outstanding amounts have been paid.
Accepted payment methods are:
BANK TRANSFER
Capture the Story is not currently registered for GST. No GST is added to the quoted price..
Where GST applies, it will be identified on the quote or invoice.
6. Late payment
If an invoice is overdue, we may:
Pause planning, editing or delivery
Withhold final files until payment is received
Reschedule work that cannot reasonably proceed without payment
Recover reasonable costs associated with collecting an overdue amount
Any late fee or interest will only apply where disclosed in the relevant quote or invoice and permitted by law.
Capture the Story may recover reasonable costs incurred in collecting overdue amounts where permitted by law.
7. Client cancellation
Cancellation requests must be provided in writing to hello@capturethestory.com.au.
The following cancellation rules will ordinarily apply:
More than 7 days before the project
If cancellation occurs more than 7 days before a project then the deposit is fully refundable.
Between 7 and 2 days before the project
If cancellation occurs between 7 and 2 days before a project then the deposit is no longer refundable.
The client is eligible to reschedule their shoot however up to 2 times.
Fewer than 48 hours before the project or failure to attend
If cancellation occurs fewer than 48 hours before a project then the deposit is no longer refundable.
If cancellation occurs less than 48 hours before the scheduled start time, or the client fails to attend, the booking payment will not be refunded or transferred. A new booking and booking payment will be required to arrange another session.
8. Client rescheduling
Requests to reschedule must be made in writing.
The client may request 2 changes of date by providing at least one day’s notice, subject to availability.
The following conditions may apply:
A replacement date must be selected within one months.
The replacement date must fall within 3 months of the original booking.
Prices may be adjusted where the new date, location or scope creates additional costs.
Third-party costs already incurred remain payable.
Additional rescheduling may require a new booking fee.
Short-notice rescheduling may be treated as a cancellation.
Any transferred booking fee will remain attached to the rescheduled project and will not be refundable merely because the new date is later cancelled.
9. Weather
For outdoor projects, weather conditions will be assessed using reasonable professional judgement.
Where conditions are unsafe or would materially prevent the agreed service from being delivered, we may:
Move the project to an agreed indoor location
Adjust the scheduled time
Reschedule the project
Agree on another reasonable solution
A weather decision will ordinarily be made 2 days before the project where reasonably possible.
Cloud, light wind, cool temperatures or other conditions that do not prevent the service from being delivered will not automatically entitle the client to reschedule without charge.
10. Cancellation or rescheduling by Capture the Story
We may need to cancel or reschedule because of illness, injury, emergency, unsafe conditions, equipment failure or circumstances outside our reasonable control.
Where this occurs, we will take reasonable steps to offer one or more of the following:
A suitable replacement photographer
A rescheduled date
An alternative service
A refund for services that cannot be supplied
The client will not be required to accept a replacement photographer without being informed.
11. Force majeure and circumstances outside reasonable control
Neither party will be responsible for failing to perform an obligation where performance is prevented by circumstances outside that party’s reasonable control.
These circumstances may include:
Severe weather
Natural disaster
Fire
Government restrictions
Venue closure
Transport disruption
Serious illness or injury
Public emergency
Unsafe working conditions
The parties will attempt to agree on a fair solution, which may include rescheduling, changing the scope or refunding services that cannot reasonably be supplied.
12. Client responsibilities
The client is responsible for:
Providing accurate dates, times, locations and contact details
Providing clear information about the required deliverables
Arranging access to venues and restricted areas
Confirming photography rules with the venue
Obtaining required permits or permissions
Informing participants that photography will take place
Identifying priority people, products, activities or details
Providing a safe and lawful working environment
Ensuring responsible supervision of children where applicable
Advising us of privacy, cultural or accessibility requirements
Providing schedules, run sheets and shot lists by the requested deadline
Ensuring that people whose cooperation is required are reasonably available
We are not responsible for missed photographs caused by incomplete information, restricted access, participant non-cooperation, venue rules, delays or events outside our reasonable control.
13. Children and vulnerable participants
Where children are involved:
A parent, legal guardian or authorised organisation must provide any required consent.
A responsible adult must remain present where appropriate.
The client confirms that they have authority to organise the photography or will obtain the necessary permissions.
Promotional use of identifiable images of children will require appropriate permission.
Schools, sporting organisations, churches and community organisations may be required to provide their own consent procedures and safeguarding requirements.
14. Start times, lateness and delays
The client should be ready for photography at the agreed start time.
Where the client, venue or participants cause a delay:
The session may still finish at the scheduled time.
The number or variety of delivered photographs may be affected.
Additional time will be subject to availability.
Overtime may be charged at $100 per hour or part thereof.
For events, the client should notify us of significant schedule changes as soon as reasonably possible.
15. Travel and expenses
The quoted price includes travel to the location identified in the accepted quote. Changes of location or travel outside the agreed area may incur an additional fee, which will be disclosed before being charged.
Additional travel may be charged at:
A project-specific travel fee stated in the quote.
The client may also be responsible for approved costs including:
Parking
Tolls
Flights
Accommodation
Venue entry
Permits
Equipment hire
Courier costs
Other project-specific expenses
Where reasonably possible, additional expenses will be disclosed before they are incurred.
16. Artistic style
The client acknowledges that Capture the Story has a distinctive photographic and editing style.
By booking our services, the client gives us reasonable creative discretion regarding:
Composition
Camera angles
Lighting
Lens choice
Posing and direction
Image selection
Cropping
Colour treatment
Black-and-white conversion
Editing style
We will take reasonable steps to follow agreed creative requirements and references, but exact replication of another photographer’s work cannot be guaranteed.
17. Shot lists and specific images
Clients may provide a list of important people, products, moments or details.
We will make reasonable efforts to capture requested photographs but cannot guarantee every requested image where circumstances are outside our control.
For events and group photography, the client should appoint a person familiar with the attendees to assist with identifying required individuals and organising groups.
18. Image selection
Capture the Story will review the photographs captured and select the images considered suitable for final delivery.
Duplicate frames, test images, missed-focus images, unflattering expressions and photographs that do not meet our professional standards may be excluded.
The number of photographs delivered will be as stated in the package, quote or agreement.
Where the client selects included photographs from a proof gallery:
Selection instructions will be provided.
Additional images may be purchased.
Editing or final delivery may not begin until selections are submitted.
Delays in selection may delay final delivery.
19. Editing and retouching
Standard editing may include:
Exposure adjustment
Colour correction
Cropping
Contrast and tonal adjustments
Basic skin or distraction correction
Application of our usual creative style
Unless specifically included, standard editing does not include:
Major body modification
Complex object removal
Extensive background replacement
Product reconstruction
Composite imagery
Graphic design
Detailed beauty retouching
Extensive manipulation requested after delivery
Additional retouching may be quoted.
20. Revisions
The package includes 1 round of reasonable revisions where revisions are expressly included in the quote.
Revision requests must be submitted within 7 days of delivery.
A revision means an adjustment to the agreed edit. It does not include:
Selecting entirely different images after final delivery
Changing the agreed creative direction
Re-editing the complete gallery in another style
Work outside the original scope
Additional revisions may incur a fee.
21. RAW and unedited files
RAW, unedited, rejected and working files are not included unless expressly stated in writing.
The final edited photographs are the completed product.
RAW files may not reflect the intended finished quality or style and are not ordinarily supplied.
22. Delivery
Final images will ordinarily be delivered within approximately 5-7 business days after:
The project has been completed;
All required client selections or information have been received; and
All amounts due have been paid.
Larger projects may require additional time. Any material change to the expected delivery period will be communicated to the client.
Delivery estimates may vary during peak periods or because of circumstances outside our reasonable control.
23. Galleries, downloads and backups
Photographs may be delivered through an online gallery.
Unless otherwise stated:
The gallery will remain available for 3 months.
The client is responsible for downloading the photographs before the gallery expires.
The client should create at least two secure backups.
Gallery reactivation may attract a fee of $100.
Permanent storage is not guaranteed.
We aim to retain final files for approximately 3 months, but the client should not rely on us as their sole long-term backup.
24. Copyright
Copyright ownership will be as stated in the project-specific agreement and as provided by applicable Australian law.
Unless copyright is expressly assigned in writing, Capture the Story retains any copyright it owns in the photographs and grants the client a licence to use the delivered photographs for the purposes identified in the quote or agreement.
Payment for photography does not automatically provide unlimited ownership or usage rights beyond the agreed licence.
25. Personal photography licence
Where a project is booked for personal use, the client is generally granted a non-exclusive licence to:
Download and store the delivered photographs
Make prints for personal use
Share the photographs with friends and family
Post the photographs on personal social-media accounts
Unless agreed in writing, the personal licence does not permit:
Commercial advertising
Resale
Use by a business or sponsor
Merchandise
Publication by a third party
Entry into commercial promotions
Claiming authorship
Applying substantial filters or edits that misrepresent our work
Businesses wishing to use personal-session photographs must contact us to arrange an appropriate commercial licence.
26. Business and commercial photography licence
The licence for business photography will be identified in the quote or agreement.
The licence may include some or all of the following:
Business website use
Organic social-media posts
Email marketing
Internal communications
Printed promotional material
Media releases
Digital advertising
Print advertising
Packaging
Outdoor advertising
Use by related entities or third parties
Australian or worldwide use
Use for a specified or unlimited period
Unless expressly stated, the licence does not include:
Resale of the photographs
Stock-library distribution
Transfer to unrelated third parties
Merchandise
Large-scale paid advertising
Political campaigning
Artificial-intelligence training
Use outside the agreed business or campaign
Additional licensing may be arranged in writing.
27. Client editing and attribution
The client may crop photographs to suit platform dimensions where reasonably necessary.
The client must not apply filters, substantially alter the photographs or use them in a misleading or unlawful context without written permission.
Photography credit is appreciated when posting online.
Where credit is used, the preferred credit is:

28. Portfolio and promotional use
Our right to use photographs for promotional purposes will be determined by the project-specific agreement or consent provided by the client.
Possible uses may include:
Website portfolios
Social media
Printed portfolios
Advertising
Awards and competitions
Exhibitions
Educational content
Behind-the-scenes content
Clients may request:
Full promotional permission
Selected-image permission
Delayed publication
Confidentiality
No promotional use
Any confidentiality requirement should be raised before the booking is confirmed.
29. Additional photographers and contractors
We may engage trusted photographers, videographers, assistants, editors or other contractors where reasonably required to complete a project.
We remain the client’s primary point of contact unless otherwise agreed.
Relevant project information may be shared with contractors only to the extent reasonably required to deliver the services.
30. Equipment failure and data loss
We use reasonable professional practices to reduce the risk of equipment failure or data loss.
In the unlikely event that photographs are materially lost, damaged or unavailable, we will work with the client to determine an appropriate remedy having regard to:
The portion of the service affected
Whether the project can be recreated
The costs already incurred
Applicable consumer rights
Nothing in this section excludes rights or remedies that cannot lawfully be excluded.
31. Safety and conduct
We may stop or refuse to continue work where:
Conditions are unsafe
A person behaves aggressively, abusively or unlawfully
Equipment is at unreasonable risk
The requested activity would breach venue rules or the law
Continued work could endanger the photographer, client or public
Where a project is stopped because of the client’s conduct or an unsafe environment within the client’s control, fees may remain payable for work completed and costs incurred.
32. Service concerns
Clients should notify us of concerns as soon as reasonably possible.
Where appropriate, we may request:
Details of the concern
Relevant examples
An opportunity to investigate
An opportunity to correct or reperform the affected service
Available remedies will depend on the circumstances and any applicable rights under the Australian Consumer Law.
33. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
34. Liability
To the extent permitted by law, our liability will be limited to losses that are reasonably foreseeable and directly connected to our failure to provide the agreed services.
We are not responsible for indirect loss, lost opportunity or lost profit where that loss was not reasonably foreseeable or was caused by matters outside our reasonable control.
This section does not limit liability where it would be unlawful to do so.
35. Complaints and dispute resolution
A client who has a concern should first contact us at hello@capturethestory.com.au.
Both parties agree to make a genuine attempt to resolve the matter through direct communication.
Where a dispute cannot be resolved, either party may seek independent legal advice, mediation or assistance from an appropriate consumer-protection body.
36. Governing law
These terms are governed by the laws of Western Australia and applicable Commonwealth laws of Australia.
The parties submit to the courts and tribunals with jurisdiction in Western Australia, subject to any rights that allow a client to bring a claim elsewhere.
37. Changes to these terms
We may update these terms for future bookings.
The terms applying to an existing confirmed booking will be those accepted at the time of booking, together with any later changes agreed by both parties in writing.
